Legal Question in Employment Law in New York
Pay Reduction After Accepting a New Position
I had accepted a new position with my company 3 months ago and signed a proposal stating what they would pay me. 3 months have gone by and I inquired as to when I was getting my back pay and raise and was told they made a mistake affecting myself and 12 other employees and our pay would be decreased by 1.38 per hour. They will pay us our back pay according to the orignal offer (14.21)and then on dec 28th we have to sign new proposals saying we will work for 12.83 or take are old positions at 11.58 per hour or quit.
I am currently still at the 11.58 since I have not recieved my raise and they owe me over 1200 in back pay. What are my rights since I have a signed copy of the original proposal that they dont want to offer.

Re: Pay Reduction After Accepting a New Position
Yours is a complicated question and there's no certain answer. You are defiitely entitled to the back wages up till December 28, 2003. Your prosepctive rights are subject to a number of factors, that are too complicated to get into in limited space. You may not have a right to a job at the wages you beleived, but its possible you could establish additional damages depending on a number of factors.
