Legal Question in Employment Law in New York

Payday dilemma

In the NYC hospital I work in, we have designated pay days, which is every 2 weeks. But my direct deposit paycheck is not available to me until the following day after payday.

Our Payroll dept said thats how it is. I can choose to get my check handed to me, which would make my pay available the same day.

Is this legal?

Shouldn't my pay be available to me on payday,regardless of whether I get my check in hand or get it directly deposited into my checking account?

It seems that we are being penalized for using direct deposit, or somehow paying for its use.

Please advise...

call the department of labor and ask them if there is anything that you can do.
