Legal Question in Employment Law in New York

Payment during two weeks' notice?

Hi everyone,

I plan to give my two weeks' notice to my New York state based employer. I do not have a contract or anything with this company - just a salaried professional.

My question - I think it is very likely that they will walk me out the door on the day I give notice. Is the employer obligated to pay me for the two weeks I would have worked, or can they terminate my employment on the day I give notice?

Please let me know - if they are not legally required to pay me for my two week's notice, I just won't give notice.....

THanks! Sam

Re: Payment during two weeks' notice?

There is no legal obligation to provide two weeks notice to your employer unless you previously agreed to do so in your employment contract.

Two weeks notice is generally given as a courtesy, but as you pointed out, rarely are employees afforded the same courtesy.

Good luck!
