Legal Question in Employment Law in New York

Pension

I am being layed off from work. My question is, how long can my employer hold my pension money. The say I cannot have my money until their fiscal year ends, which is another 10 months. I work for a non-profit organization and they are closing my dept because they say have no money to continue running my dept, but they are going to hire an outside contractor. Is this legal? thanks.

Do you have a copy of the summary plan description that outlines your benefits under the pension plan? What does it say about vesting? Outsourcing your job is not by itself illegal, but if the reason they are doing it is discriminatory you might have a cause of action.
