Legal Question in Employment Law in New York
I was recently conditionally hired pending passing a pre-employment drug & alcohol screen. The test results took 5 days to return and I was contacted today, asked to start work tomorrow. However, 2 days ago I was charged with a Misd. DWI. Per review of the companies emolpyee handbook I found they have a policy stating any arrests, except for minor traffic infractions, must be disclosed to HR with 72 hours of the arrest for review and possible termination. Failure to notify will result in immediate termination upon discovery. So, do I need to disclose this incident on my first day of work, after having passed their screening and having no prior criminal background?
