Legal Question in Employment Law in New York
I was recently laid off from a privately owned Restaurant. As a Manager who was there for over a year, I was owed a paid, week long vacation that I was unable to take as I was terminated with no notice. My question is, is the owner of the Restaurant legally obligated to pay that amount to me in my upcoming last paycheck? There wasn't anything regarding that in the handbook nor did we have a use it or lose it policy. He's saying he won't pay it because he legally doesn't have to so I figured I'd get a second opinion.

Tell him that you will file a complaint wiith the NY State Department of Labor and if that does not result in his paying you, you will sue him in Small Claims Court. Either remedy is cheap and usually effective.
