Legal Question in Employment Law in New York
I recently voiced my concerns over safety issues and violations procedures being committed by supervisors at work. I work in a sensitive field where we are required, by company guidelines as well as insurance guidelines to work in pairs. In an effort to cut costs or where there is a lack of man power, the company forces us to work alone which is a violation of insurance and company policy. On Friday, May 20th I voiced my concerns about the blatant disregard for of company policy and worker safety and was basically told who cares I have to do it. After expressing myself and informing them I will NOT put myself at risk for injury any longer and threatened to notify our insurance about these violations, I was immediately suspended and asked to leave. Later that evening I was informed over the phone I was terminated. Since this incident, I have been contacted by the companies HR lawyer who informed me she would conduct an investigation regarding my allegations. Late that evening the same lawyer sent me a text asking if she can once again speak with me. She stated to adamantly, that i was not fired. I told her I have a recording that I was fired as well as witnesses who heard the supervisor brag about firing me. This is the second time I have been retaliated against. The first time was in early Mrach, when I had my hours slashed in half because I asked for a raise. Just curious if I may have a wrongful termination case. This a brief synopsis of what is going on. Based on what the attorney said, I would suggest you go to work tomorrow but do not speak with anyone about the circumstances at hand, the concerns you raised etc. You may want to bring a small recorder with you that is turned on so if they formally say you have been fired you can ask what the basis was etc. and have it on tape..
