Legal Question in Employment Law in New York
Refused payment of vacation time accrued
I gave 2 week notice to my employer, and mentioned that I would like to take my 5 days of vacation time accrued prior to departure. My manager and department manager refused to allow me to take my vacation time. Firm policy is such that the firm will not pay for accrued vacation time not taken after severance of employment. It is my understanding that I am owed this money as it is part of my wages. As my managers would not allow me to take the vacation time while still employed, I fail to see how the firm can get away without paying me. Total value of 5 days vacation owed is $1025.

I agree with you. Since the sums are low for a New York lawyer to litigate, and you would have to pay a large percentage to get representation, consider Small Claims Court and do it yourself. What can they do.... fire you?
