Legal Question in Employment Law in New York

Reimburse Emplyer for Training expenses

I am a Rela Estate Agent and because that an independent contractor. I was asked to sign a sheet stating that I agree to reimburse the company for training that I went through at the beginning of my career if I leave the company to work for a competing broker withing two years. This isn't very formal, but I did sign. How well would this paper hold of in court. Does the company have a right to collect for training or would they have to prove their cost first to make their charges legitamite.

Yes, as long as they are not asking you to stay at the job too long. In this case two years would be reasonable.

Good Luck.

Re: Reimburse Emplyer for Training expenses

This type of agreement is fairly standard in many industries and has consistently been upheld in court provided that the length of time is reasonable. Two years would be considered reasonable by most courts. A good course of action would be to try to get any new broker to agree to reimburse your previous broker for the training or to negotiate a pro rata share of the training expenses based on how long you worked there.
