Legal Question in Employment Law in New York

Do I have to retain employee when purchasing business.

I am purchasing a small Insurance business that I have worked at for 20 yrs. The one other employee has been out on Disability for 1 mo, unsure if she will return before purchase is complete. I really don't need any employee. Is there any legal way that Upon or prior to purchasing the business that I can stipulate or provide notice that can terminate her employment upon my purchasing the business. (even if she is still out on disability)
