Legal Question in Employment Law in New York

Retaliation

About two months ago, I reported sexual harassment to HR which had been going on repeatedly for over 9 months (since I started the position). The harasser was fired after a thorough investigation, which I had extensive evidence. The harasser and I were the only two people that were in our positions and now I am the only one in the position. Since then I have been working extensive overtime hours and completing the work of two. I have been moved around the office to sit in front of upper management. His position (Sr.) came up and I applied for it 3 weeks ago. My boss told me that she I would get an interview and I haven't. They have completely overlooked my resume and application for the position, but I am doing it now. Since then, two employees involved in the investigation have been treated unfairly with promotions and termination. Do I have a discrimination or retaliation claim?

Re: Retaliation

You may have a valid retaliation claim, but because these cases are so fact-specific, more information is needed. You may also have a valid sexual harassment claim as well.
