Legal Question in Employment Law in New York
Retirement severence pay policy
I am 62 years old and expect to retire within the next 2 months. I have been told that I will receive no severence pay due to the fact my job will be replaced. However; I know of individuals within the co. that received severence
upon retirement and had their positions replaced. The policy seems to be that if a manager supports you, severence, along with other fringes are given quite freely. This policy is kept hushed and numerous retirees have received nothing. I question the legality of a policy of severence based on favoritism and friendships rather than a policy of equal treatment for all employees of this rather large electronics firm. Is their any legal recourse for myself and other potential retirees?

Re: Retirement severence pay policy
It's unclear to me what you mean when you say that your position was replaced. If your company has a severance policy then everyone who is qualified to receive it should receive it. If the severance is being doled out based on discriminatory criteria you and similarly situated retirees should contact a lawyer.
