Legal Question in Employment Law in New York
Severance pay question
I was recently told my position was no longer needed and offered 3 weeks severance. I was given the option if I wanted to stay and work for one more week then the severance would begin. When I received the paperwork the company post dated my termination date so now I can't collect unemployment until after that date. Basically, they are keeping me on the payroll for those three weeks. Doesn't seem fair. Is it legal?

Re: Severance pay question
You should always speak to an attorney before signing any paperwork relating to your severance. Although often times it is preferable to remain on payroll, each person's circumstances is different.
