Can I sue my union and my employer?
I for the New York City Department of School and Nurtition, and my problem is that I am coming from my second knee surgery after my district supervisor put me in a site that is very physical after my first knee surgery. At this site it has been nothing but harashment from the first day got there despite me doing everything that I was told to do. I asked for a transfer and even put it in writing like the district supervisor required . I also told my union rep and had a meeting with her boss which I explained about this problem, and acoodrding to my rep when it was brought up to the district superviosr she claim she knew nothing about my unhappiness there. I aslo since 2006 when I had my first knee surgery , ask the union (Local 372) for assitance in finding a less physical job which until this day I have not recieve. I only recieve nasty comments from my rep and empty promises from her boss. Now, I am going to be out for awhile and I wondering can I sue both of them because it seems to me that the district supervisor put me in that site after my surgey and gave orders for the staff to abuse me to make me quit , and the union who complaints fell on death ears.

Its not that simple. Basically you can, but the result would be arbitration of your grievance.
