Legal Question in Employment Law in New York
Suspended at work. fear losing job
I work emergency sevices recently attended a disiplinary hearing where i was accused of refusing a job and not properly updating on an assignment.I was threatened that i would be suspended pending listening to recording on a taped phone line.at this hearing the tapes that my supervisors used against me revealed that i NEVER refused assignment and DID update accordingly.i chose to defend myself in this meeting and they refused to let anyone stand in on my behalf as an advocate.i felt like i had to protect myself since the night before one of the supvsr in the room stated everything is up for interpretation and its her word against mine.the tapes proved nothing and i was giving a warning and admonished for i still don't know what. because i felt like i had to protect myself i brought with me a tape recorder and taped the conversation. my supervr who i believe knew i was taping the whole time approached me 6 days later and suspended me on the spot. i am not aware of any policy prohibiting recordings, neither is anyone else who's employeed there, and i was offered no representation. both meetings put me on the spot no notice. issues involved also relate to threats of disciplinary action if unwilling to work past 16hr with no meals
