You may tape a conversation that you are a party to in NY.The fact that the other party is unaware,standing alone, is not a bar to using it as evidence.There may be other problems such as hearsay etc.If you are in an administrative forum which is where you have to originate your discrimination complaint, assuming it is employment discrimination,your tape can be used.

In New York, generally it is legal for a party to a conversation to taph phone calls that she is involved in. As for the particualr situation I cannot give you a definite answer without more detail.
