Legal Question in Employment Law in New York
I was terminated from a job that I had worked on for 9 years..never written up, verbally worned or anything of that nature in all the time I worked there. I had an arguement with a co-worker(fairly new on the job) whom I had been having problems with. I was terminated for misconduct. I applied for unemployment and was denied. I put in for a fair hearing because the company wrote back to unemployment saying that I verbally assaulted this co-worker which was untrue. I had the fair hearing and won. Of course there were lies told by the employer so I wouldn't be able to get the unemployment. The first one was I told the supervisor I was gonna punch this co-worker in the face..when I got to the hearing it turned from that to I was gonna kill her.. can I sue this company for defimation of character and wrongful termination?

No, this is not a defamation of character case. Besides, there is immunity from a subsequent suit for statements made in a judicial a quasi-judicial proceeding.
