Legal Question in Employment Law in New York
I thought that I saw another employee stealing. The same employee also spent over a hour badmouthing our immediate supervisor. We were very busy at work so I tried text messaging my immediate supervisor about what had happened. Unfortunately I actually sent the text to the employee that I was accusing of stealing and badmouthing. He called the business owner who screamed at me for ten minutes and then sent me home early. Scared that I may be fired over this or have my schedule shifted around until I quit. Do I have any legal rights if I am terminated or if they start to drastically cut my hours and schedule me for shifts I am not able to work?
1 Answer from Attorneys
If you are subjected to an adverse employment action, such as reduced hours or termination based solely on your complaint to management regarding theft by a co-worker, you may have a claim for retaliation under the "Whistleblower" Act. In the event any action is taken against you, you might want to consider hiring an employment attorney.
