Legal Question in Employment Law in New York
Hello! Can I get unemployment benefits if I resign due to the living arrangements given to me on a longterm assignment out of the country is not suitable? Per my work contract, we are only to work between Jan-April on longterm. I have started working in September 2009 and will be thru April 2010.This is a breach in contract.
The living arrangment given to me is in a corp apt without security and in an industrial area. Bldg mgmt. came into my apt without permission due to emergency below apartment. I am now nervous, anxious and can't stay there. Company will not put me up in hotel. It is either a motel for next 4 months or another corp. apt. I feel unsafe and my personal well being is not being protected. I am stressed now and anxious and getting sick over this. I didn't go back this week as I fly home every other weekend. Should I resign and will i get unemployment or should I get fired?
Thanks for your help.

Based on your fact pattern, it is very likely that you will be denied unemployment benefits because it appears that you employer is willing to make some accommodation to your housing situation.
