Legal Question in Employment Law in New York

Unemployment eligibility

I have been told either to resign my present job or relocate to a different facility and take a 30% pay cut. The facility they want me to go to does not have public transportation which I usually use. Am I eligible in New York, at least until I have a chance to look for something in the same pay range? Thank you

Re: Unemployment eligibility

I remember that being forced to take a reduction in salary or taking a job with a lower skill level/status than you previously performed is tantamount to being 'fired,' for purposes of collecting NY State unemployment insurance.

you may quit (and write out the reasons for doing so in a resignation letter saying 'you told me that I must resign or have my salary reduced') so that your employer cannot dispute the reason for your resignation, or blame you for 'acting up' at the job site.
