Legal Question in Employment Law in New York

Unemployment Question

Hello - I recently applied for unemployment benefits

in New York State. I meet all of the qualitifations

except for possibly one: A year ago I filed for a DBA

in case I ever wanted to perform consultant work

outside of my full-time employment, however, I have

never earned anything via the DBA, it simply exists.

Does simply having a dba (eventhough I earned

nothing) disqualify me from getting unemployment

insurance in New York State? Thanks very much

Re: Unemployment Question

It should not, and if it has, you need to dispute the determination, and request a due process hearing from the Department of Labor.
