Legal Question in Employment Law in New York

Unpaid overtime

Hello, I have been employed with a company for 4 years. During my employment with this company I have always been a hourly employee. It was mandatory that I worked over time but i was never paid or received anything for my time. I was laid off in feb and I would like to seek payment for my unpaid time. My only problem is that they refuse to given me any of my time sheets. I am owed about 20k in overtime. Is this worth going forward with?

Re: Unpaid overtime

Definitely! You should contact the New York State Department of Labor - http://www.labor.state.ny.us/

The DOL will investigate your claim and can require your employer to produce your time sheets. If the DOL determines that you are owed overtime compensation, the Department will attempt to resolve the issue or, if needed, file a complaint against your employer for the owed wages.

Re: Unpaid overtime

You should definitely give our offices a call. We handle overtime cases (see my website). There are real wage payment issues that a lot of companies are failing to comply with, and we may be able to force them to pay you your unpaid overtime.
