Legal Question in Employment Law in New York

withheld pay

I worked for 2 days at a job that I decided didnt suit me. I offered to continue working on a part-time/hourly basis but they declined and said they would send me a check for my 2 days there. That was in November and I have contacted them 3 times since and they dont respond to my messages. I am at my wit's end and I need the money while I am looking for a new job. What can I do? I told them I would take appropriate action if they didn't send the money they owe me (they sent an email that originally stated they would send the pay for the 2 days I worked there).

Re: withheld pay

Your former employer's conduct is not only wrong it's illegal. You are entitled to be paid for all work completed. In fact, you may be entitled to liquidated damages (twice what you're owed) for their bad faith failure to pay you. In the event that you sue them for your wages, they may also have to pay attorney's fees under both NY and U.S. law.
