Legal Question in Employment Law in New York

Work Related Rights

Two years ago my ex boss offered me a position that was available within the company and I immediately accepted. I have it in writing, from him of my decision and where I was going and who would be my supervisor. A few months after my transfer my new boss resigned and I was placed under the supervision of someone in a different department. My new supervisor has no clue as to what it is that I am training on and working on and continues to pile on work and taking my time to train in other areas from her department. Im being steared away from the job I chose to transfer to, trained and continue to train on. Needless to say I am overwhelmed and stressed and it's affecting my work performance. I feel I am being set up to fail. Do I have any right here? Thank you.

Re: Work Related Rights

The answer to your questions depends on what, exactly, is in writing. In general, an employer has the right to assign work tasks to you, and to offer you training or not as the employer determines is in the best interests of the business. However, if you have a written commitment from your previous boss, and he/she had the authority to make such commitments, you may have a valid argument for not agreeing to any changes. An experienced employment attorney can look at the writing you have and describe your rights. Feel free to call my office to discuss this further.
