Legal Question in Employment Law in New York

My husband was working for a contractor located in NY. He was working on a cash basis. On this day he fell from a roof approx 20ft for which he is in care of many doctor specialists now. The owner told him that he could not collect his pay due to the fact ''he fell early in the day''*** and did not do enough work! NY is a workers comp state, now we are told that he did not have workers comp for my husband, can we pursue legal action and receive workers comp with this company? I would appreciate any and all help in this direction.

Absolutely! Your husband's employer had a legal obligation to get worker's compensation. You may also have a legal claim againstthe property owner where your husband was working. Contact the New York State Department of Labor and make a complaint.
