Legal Question in Employment Law in New York

Possible workplace harrassment

I am a teacher in an urban school district in Upstate New York. I have a student who continually refers to me as either ''Sweat ASS'' or ''Sweaty Cheeks.'' Could this be considered harrassment on the part of the student?

Re: Possible workplace harrassment

Employers are responsible for providing employees with a working environment that is free from sexual harassment. This applies to harassment from co-workers and third parties, including students.

If you have not already done so, follow the sexual harassment complaint procedure. Keep in mind that you have rights under federal and state law. To preserve and protect your rights, you must file a charge of employment discrimination with the Equal Employment Opportunity Commission ["EEOC"] within 300 days from the date of the alleged discriminatory action. You can reach the Buffalo office of the EEOC at 1-800-669-4000.

Good luck.
