Legal Question in Employment Law in New York

Wrongful firing might happen.

My wifes company wants to fire her due to last years maternity leave in which they messed up on time aloud off.She was told via our doctor she was high risk & had to stop working & her job said ok but also beat her out of 6 weeks off & now said she is wrong for taking the maternity leave ahead of schedule. they now put her on notice for last years mess up on their part. The real reason is due to her making a larger salary than the other workers. Can they just make up last years messup & fire her for no reason? thanks

Re: Wrongful firing might happen.

From the facts you presented it is difficult to ascertain whether your wife's employer has violated any laws. It could be that the employer has violated the Pregnancy Discrimination Act, but we would have to get more detailed information from you before we can make any determination. If you would like to talk to an attorney about this issue, you can call Raymond Iaia or Thomas Minotti at (914) 949-6323.
