Legal Question in Employment Law in New York
Was I wrongfully terminated
I have been wrongfully terminated. I was terminated because I am hispanic and the boss I have now didnt hire me and he was upset about that and right before I was fired he hired 2 more guard both black. I was dismissed without any reason what so ever, I was told to start looking for another job, that it wasnt working out, clean out your locker your history those were his exact words. Since my employment here he has hired only one other hispanic. I am putting all my efforts in this matter because he did not have a good enough excuse to fire me. And to be told your history was very unperfessional and uncalled for.
There are other hispanics here but they have been here for years before he became there supervisor. I had only one incident with him and that matter was resolved he waited until 1 week before I became permanent to fire me I was there for 5 months and 2and half weeks. Right before the holidays and I pay child support for my son. I dont want him to get away with this. And the organization I was working for is . I can be reached at I have called employee relations and I was told they would get back to me and I was fired on 11/16/05

Re: Was I wrongfully terminated
You have already received good, useful advice from two other attorneys regarding your question. Nevertheless, I hope may also use the following information to your advantage:
The EEOC referred to in one of the prior replies is the U. S. Equal Employment Opportunity Commission. Their website is www.eeoc.gov, and on that website you will find instructions on how to file a complaint, how to contact them, etc.
The New York EEOC office is located at
33 Whitehall Street in Manhatta, New York.
The office is open from 8:30 A.M. to 5 P.M., Monday through Friday, but you must telephone ahead to make an appointment first. Their telephone number is listed on their website and in the telephone book directories.
I recommend that you discuss your options with a qualified attorney such as either of the two attorneys who previously replied to your question so that you can consider your options before going to the EEOC s as to realistically assess whether you could bring your case to court ad the implications of going to the EEOC. Note that you have a 300 days deadline sfter your termination to file a complaint with the EEOC.
Re: Was I wrongfully terminated
You can contact the NYS Division of Human Rights (they have a website) or the EEOC if the company has more then 15 employees. The State will accept complaints for the EEOC through the Division.
They will investigate and issue a determination of whether there is or isn't discrimination based upon national origin.
Eventually if they find in your favor you have a hearing for damages before an administrative law judge.
If not they will provide a right to sue letter showing you exhausted the administrative remedies available.

Depending on the circumstances your termination may be actionable. If you'd like we can speak about your specific circumstances.
