Legal Question in Landlord & Tenant Law in New York

Is a 30 day notice to move required in New York state on a month to month tenancy? I want to take my ex-landlord to small claims, but I did not give my ex-landlord written notice, only oral, but he has not returned my security deposit and it's been 10 months since I moved out.
