Legal Question in Landlord & Tenant Law in New York

30 Day Notice/Permission to Enter Office

I received on April 15 a letter notifying me that my month-to-month lease (we no longer have a written lease) on a commercial office space (in NY) will terminate on April 30, a 15 day notice. Is the notice invalid since I was not given 30 days notice? If so, how do I respond and what are my rights? Secondly, I am concerned about the security of my office, as there are highly confidential files in my office. Is it true that the landlord must give me at least 24 hours notice to enter my office and I must approve? I have on a good source that the landlord entered my office without notice to me to show a prospective tenant around. Is this illegal and a form of trespassing? Should I have contacted the police? Thanks

Re: 30 Day Notice/Permission to Enter Office

Generally this type of notice would not comport with the law. If you need more time I would send the landlord a notice saying such, any you may want to consider moving by order to show cause in housing court.

Should you like to discuss this or any other legal matter, you can e-mail me for more information about low cost face-to-face, on-line, or a telephone consultation with a lawyer in our office.
