Legal Question in Landlord & Tenant Law in New York
Hello, after 3-years in an apt. the landlord needed the place for family and gave us 5-weeks to leave. Our rent was paid and at the end of we were on the verge of homelessness, 2-adults, 3-late teens, 2-boys 6+7. Noone would rent to us (too many bodies), I started nudging realtors and one helped us. We are in a huge beautiful 5 to 6 b-room, 3-bath home and paid $2000 up front for 2-months rent no SD required. It has been forclosed now and the landlord is into bankruptcey. We signed a month to month lease, but there is a major water leak in the basement from the main line and we now upon need find no heat. There is no official notice yet, but we get around and know many people so we know the foreclosure is true. The realtor has also stated that the process was ongoing and near. The for-sale sign went down a week after we paid the cash to the realtor co. who had the sign in the yard. We sit in limbo now and back to square one having difficulty finding a place to go. We have been led of sorts to think by the realtor that we must leave at months end when our rent is used up. The landlord told me in the only converse we had he did not want to rent the place, but needed the cash. We all love it here as we came from a tiny apartment us all and whis to remain. My 7-year old is up for a serious mouth operation on Oct. 2nd and the wait list is long again if we cancel. I fear for his stress level if we are in a move then. Can you advise me on our rights in Gensee Co, Western NY and to whom should we send the rent to for Nov., as I have read that month to month tenents must be given 90-days notice to vacate. Is this true and can you advise about the rent payment and where to direct it. Should we pay someone to come in and repair the heat and leak? Does it happen that we could end up staying and tending the place for the bank, now landlord or is this a fantasy? Also any other info. you think I should be armed with I would appreciate. Sorry so extensive and can't pay, our rent went from $600 to $1000 and we are pinched on all sides, but I will refer my more fortunate friends here if they have a need in the future.
