Advertising Tenant Association Meeting
My building has an informal tenants association. Whenever we have a meeting, we distribute flyers to individual residents (under doors) and, one day before the meeting, post flyers in the building lobbies: one on the bulletin board above the mailboxes and one in each of the two interior lobbies beside the front doors. Each time flyers are posted, our landlord removes them. Recently he informed me that we have no right to post the flyers in the lobbies. Is this correct?

This is really a fact specific question. A landlord in NY cannot discriminate against a tenant association. The question really becomes, does the landlord allow the posting of any flyers in the lobby? If he has a blanket rule that covers all postings he's probably on solid ground removing the tenant association flyers as well, however if he allows postings about other topics but only excludes the tenant association posting well, then...

I disagree with Mr. Loeb. Banning the flyers will prevent the functioning of the Tenant Association. The Landlord cannot interfere with the functioning of the Tenant association.
