Legal Question in Landlord & Tenant Law in New York

Apartment Renters Right to Sue

I rented an apartment on Dec 1st, 2008, on December 15, I purchased 25,000 renters insurance policy(thank god) and on December 20 my apartment was destroyed by fire, due to a faulty timer button on the stove(landlord owned)which wasn't even turned on I lost everything, my landlord said that renovations would be done in asap, he was told it could be done in 3 months & told me my apartment would be nicer than ever, it is now March 10 and nothing has been done, I was living in a hotel until March 1st w/ my 2 kids, now in temp housing, still paying my normal rent, my landlord still has my security deposit and I have been inconvenienced far too long, removed all of my personal property as soon as I was able to re-enter the premises, I have rented a pod for what little was left which remains on his property, everytime I call landlord he tells me that hes still waiting to hear from ins co.I have been very inconvenienced moving often, might I mention that I am disabled? Just looking for some advice and wondered what are my rights re: matter any advice would be appreciated......

Those are pretty complex issues that I don't think can be fairly addressed in a forum. You should schedule an appointment with an attorney experienced in landlord/tenant practice.

I agree with Mr. Spector and Mr. Markowitz. However, I would have to see the lease to answer the question more specifically.

If you would like to contact me, please feel free to do so.

Re: Apartment Renters Right to Sue

I would look for another place to live, terminate the contract and seek return of your security deposit.

Mike.
