Legal Question in Landlord & Tenant Law in New York

Appoint a Proxy for NY Small Claims Court?

Two of my former roommates and I received a summons to appear in court because we are being sued by our former landlord. We are supposed to appear next week, however I am out of the country for work for one year.

My question is, is it possible for me to assign someone as my proxy? Perhaps one of the other defendants (although we're not sure if we're being sued together or seperately). If this is possible, do I need to fill out any sort of form or authorization? Any info would be appreciated.

No. An individual cannot appear for another in Court unless admitted to practice law. However, you may - with a letter - ask the court for an adjournment since you will be out of the country. I do not know if the Court will grant a year adjournment.
