Legal Question in Landlord & Tenant Law in New York

LOOKING FOR ATTORNEY!! Landlord ignoring stip of settlement!!

We signed a stip of settlement and in it, the landlord agreed to a have MAJOR repairs completed on designated dates by a lic. contractor, and we would leave on Dec 31. The repairs were never started or completed and now we have damages to personal property, as well as having to return $6K in cllients money ( Im a wedding planner), due to water damage to invitations and such. We had to use the $$ in the bank to return the clients money, and that was designated for moving expenses. I have contacted our LL attorney and he stated our LL never had any intention of making the repairs, and he no longer represents our LL. Now what? Small claims or Housing court since it will take some time to re establish our funds in order to move? Would the Judge entertain such a request? Thanks for any help.

Lots of "if"'s coming. If the repair work was supposed to have started before the damage arose to your property (and if other factors also existed), you may have a basis for claiming the LL is liable if the lease doesn't negate it. I think the better question is if you have grounds to vacate or "stay" enforcement of the stip thus postponing your vacate date. I could only answer that after a consultation (free).
