Legal Question in Landlord & Tenant Law in New York

Back Rent

My landlord is my brother in-law/Sister in-law and they have been in the process of getting a divorce for the part 5 years. We fell behind in rent back in 2002 and 2001, he never asked for the monies and now that the divorce is comming to a close he is asking for it, we still live in there house and have been paying rent. Can he go after us for past rent years later?
