Legal Question in Landlord & Tenant Law in New York

bamboozled

My sister signed a waiver to release her right and security deposit because the management office said that they wanted to offer the current occupants a lease in their own name. The occupants are my husband, and children. Of course, once the waiver was signed, notarized, faxed and original mailed, the management company began an eviction of my family. We have lived in that apartment for 27 years off and on. The apartment has always been in my sister's name. The apartment complex is a condo conversion with option to still rent. We have a holdover court hearing on November 3, 2006, and we all plan to attend. I'm just wondering if it is too late to fight, and if we have any rights. The apartment complex is subsidized.

Re: bamboozled

Get yourself a good NY rent control attorney immediately and fight it. Reasonable apartments are rare, indeed. It's worth paying an attorney, considering the difference they'd be paying in rent.
