Legal Question in Landlord & Tenant Law in New York
I took in a boy six years ago, my son's friend who was homeless. He is now 24. I lost my job 18 months ago. At that time I asked him to contribute $50.00 a week. He promptly quit his job and has not worked since. My son moved out last year. I have asked him repeatedly to move out. I can't afford to support him. Doeshe have any rights? What can I do?

To evict the individual, you must first give proper notice under the law to revoke his right to remain on the property. Generally, this is a 30 day notice (one full calendar month). At the end of the period, you would commence a summary proceeding to evict the individual. Upon being awarded a judgment of possession and warrant of eviction, you would have either the sheriff or marshal execute on the warrant. There is no self-help eviction in NY.
