Legal Question in Landlord & Tenant Law in New York
Breaking a Lease
My daughter has 6 months left on her apartment lease. Since moving in her car has been vandalized & broken in to and now her apartment has been broken in to as well. She is a young college student livng alone and is scared to death to go back in to her apartment. As her Mom, I fear for what else could happen to her. Under the circumstances (police reports are on file as proof) can she get out of her lease so she can find an apartment in a safer part of town?

Re: Breaking a Lease
Failure to provide adequate security is deemed a breach of warranty of habitability. With a breach the tenant is entitled to vacate the premises.
