Legal Question in Landlord & Tenant Law in New York
Commuter Housing/Crash Pads
I am a flight attendant living in a commuter pad in NY. I signed a lease for a year last August. Five days ago, notes were posted giving tenants till June 1st to move out. The management has least the entire floor to an individual who runs commuter housing. An option was given to all to find another place or move upstairs from the 1st floor to the 3rd floor. Most of the tenants currently living there were away. The new lease holder already started moving people in with our property still in the rooms.
With NY's law, is the management office required to give us 30 days notice? Can they legally break the year lease without penalty? Can the new lease holder legally begin moving his new tenants in before June 1st.

Q. With NY's law, is the management office required to give us 30 days notice?
A. Right now you are operating under a written lease agreement. Therefore, the language in the written lease takes precedence. If you are a holdover tenant - having possession of the premises after August - then the 30 day notice takes effect.
Q. Can they legally break the year lease without penalty?
A. It depends on the language in the lease agreement. However, generally, the answer is no.
