Legal Question in Landlord & Tenant Law in New York

Is he considered a resident if he lives in my home; but isn't on the lease?

I am wondering if someone living in the same home with someone; and isn't on the lease, pays half the bills; and received his mail there is considered living there? And with that when a court issue comes up; do they need to include his income as part of the HouseHold income? Thank you.

Yes, the person is considered living there and,

no, probably not,i.e., the person's income would not be considered as part of the household income of the other, either for the purpose of court or other matters(unless the relationship involved some type of domestic partnership legally recognized in the area), but without having more facts and, in particular, facts which relate to the nature of the relationship of these dual dwellers, a definitive determination on this particular issue cannot be made.
