Legal Question in Landlord & Tenant Law in New York
Do I have to go to court to get someone out of my house that does not have a lease that I said could stay at my place until he found a place to live? He is doing illegal drugs and eating all of the food in the house, stealing from us and ruining our things. I live in Suffolk County NY.

Generally, yes. However, if he is doing illegal drugs you may be able to receive help from the Suffolk District Attorney.

If they had permission to be living there, and the police are not helpful, you must properly initiate summary proceedings for their eviction. As New York State law is very specific as to the exact wording required in these Notices and the manner in which they must be served upon the tenant, it is highly advisable to retain the services of an attorney experienced in these areas. We have handled many such cases, however, we would need some more information before making a complete and proper determination. You are welcome to contact us for a free consultation.
