Legal Question in Landlord & Tenant Law in New York

My daughter rented an aptfor the summer and the landlord overlapped contract with current tenant. He suggested they share the bedroom during the overlapping period and use the garage for her personal belongings. Can she back out of her contract and get her mobey refunded?

Obviously, the LL breached the lease and your daughter should be able to terminate and have her $ returned. Whether the LL will cooperate is another story.
