Legal Question in Landlord & Tenant Law in New York

Defamation of character

I have been asked to leave my apartment on December 30, 2004. Have just started a new job, and have found out through a coworker that my landlord is speaking about my personal business in a local establishment that my coworkers frequent. Do I have any legal rights to sue for slander, as this information is detremential to my character?

Re: Defamation of character

Potentially, but the information must be defamatory and untrue. You will also need to prove actual damage as a result of the defamation.

Should you like to discuss this or any other legal matter, you can call my office to schedule an appointment for a consultation or in the alternative, I can be reached for on-phone low-cost legal consultation at 1-800-275-5336 x0233699.

Re: Defamation of character

This is an interesting question. It can be analyzed in two (2) ways.

First; if the information was transmitted or discovered through your relationship with him as your landloerd (from your financial disclosure when applying for the apartment) you have a very good case without showing the information is false.

On the other hand, as a straight slander case, you must show the information was false, fits the legal definition of 'bad', and that you have been injured.

You are welcome to a consultation.
