evicting tenant from illegal basement apt.
house was bought 4 years ago. two
tenants moved out but a couple lived
in basement. the old owner said they
were poor and had no place to go
could they please stay? I said yes.
they lived for 4 years. they stopped
paying rent. when rent was
requested they said they were told
by 'tenant assoc' not to pay rent.
tenant was issued a 30 day notice.
they laughed and said '' u have to
take me to court to get me out & I
dont have to pay u a penny'' I was
told that notice of petition was only
for legal apts. what to do?

Depending on the circumstances you may be able to have them evicted via a notice of petition. Otherwise you may have to file an action for ejectment with the Supreme Court. Either way it it would be highly advisable to retain an experienced attorney. Much depends on the location of the dwelling and your Certificate of Occupancy ("C/O"). Assuming you are anywhere in NYC, unless you have the proper C/O those basement tenants can assert it is an illegal apartment. The ONLY way you can force them to vacate is by court order; an eviction proceeding or ejectment action in other words.
I would recommend that you retain a qualified landlord/tenant attorney to represent you.
