Legal Question in Landlord & Tenant Law in New York

Eviction - Complained about Manager

Manager of apt. complex wouldn't give up the owners name. I did an internet search & found some names. I called, man said he might know who owns the property (not him) & wanted to know my complaints. I told him a few problems (repairs & suggested manager was up to no good.) He said he will get in touch w/ owner & get back to me. He never called & I never persued. We have been looking for a new place anyway. Well today we rec'd a cert. letter for a 60 day vacate notice due to renovations (from the manager, not owner.) We know that no permit was applied for any renovations. I would like to how to handle since this request was not from the owner. Please help

Re: Eviction - Complained about Manager

Landlords come in all sizes and shapes. This does not sound like a good one.

1) the county courthouse will have the owner of the property available to you as a public record. It will be in the 'recorder's office'.

2) how much time do you need to move? The whole problem could be 'moot', settled before the date for the request to move is an eviction. Do you want to fight this?

3) if you want to fight, then this is an easy one. You can take the matter to housing Court as an unlawful eviction. The 60 day notice will function as a notice of eviction and you may contest the eviction on the basis that there are no renovations and therefore no legal justification for the eviction. You may even be awarded legal fees (they must pay for your lawyer) in a case like this.
