Legal Question in Landlord & Tenant Law in New York

eviction

i have a tennant without a lease who has not paid me rent sine Jan. 09.he refuses to leave. i have sent him an eviction notice and i have a court date.my question is, can i state that i want my apt. back without going onto the fact that he hasn't paid rent?i'm afraid if i say that, he will make up stories why he hasn't paid and prolong the case...i just want him out....can you please advise?

It depends on whether you brought a non-payment proceeding or a holdover proceeding. If you commenced a non-payment proceeding, you cannot hold information concerning the payment of rent.
