Legal Question in Landlord & Tenant Law in New York
my father owns a coop in yonkers new york on the 1st floor. There is no one below him buy crawl space. There are 4 tenants in each building two below and two above. Two years ago tenants moved in two years ago. He works nights. They never put in the required 80% wall to wall carpeting. There
have been problems with the above tenants different schedule. My father is 75 and has recently lost
my mother to cancer after a 2 year battle. We notified both the management agent and they in turn
contacted the board we received a letter 2 months ago stating because of the conflict both parties must cover 80% wall to wall. The inspection was done 30 days later my father had his done but the upstairs tenants did not. Another letter was sent to them stating that they had 30 additional days to meet the requirements. If they did not, legal action will take place at their expense. My question is that the inspection is being done this Thursday. They stated that they never received the bylaws of the coop unit that stated that all apartments must have their floors covered 80%. I know for a fact that at the interview for approval by the board this is one of the requirements which is always stated, I know for a fact nothing has been done what can we say and do at this next board meeting when they state that this isn't done that we can cover outselves keep in mind my father spent over $3,000 to meet the boards requirements and he also has asmtha. Could you give me some advice on how to handle the board should they give hime more time. The noise between the hours of 12am-4am is horrible and my father is 75 years old and is under a lot of stress from this situation. Help Connie
