Legal Question in Landlord & Tenant Law in New York

Father has a successful medical practice and now is ready to retire. He doesn't want to pass/give his son the business however. Father owns the condominium unit and instead wants to lease the space to his son.

The catch is that the father still wants to be able to use the facilities ANYTIME he wants if he feels like working! They cannot agree on anything! When repayment is suggested in the form of working it out as if "now the father is an employee", all hell breaks loose and he says "it's my office and my practice, and I'll come and go as I please!". Their relationship has been deteriorating. . .The son knows that he could leave but has spent years there and also has invested a lot of his own money in this practice. The father has always refused to make him a partner. The son now feels abused. In the end the son is willing to concede to a lease agreement but it has to benefit both and not just the father/landlord. Any suggestions to resolve this? Thank you
