Legal Question in Landlord & Tenant Law in New York
Fungus in ceiling
I own a co-op apartment in a building where the sponsors are renting apartments also. One such tenant lives above me for less than 2 years. I have had 4 leaks from that apartment in the past year and a half. The latest leak was a few weeks ago and they are waiting for things to dry out before replastering my bathroom ceiling and walls, but in the meantime I have to be removing fungus that is growing out of the cracks in my ceiling, and the smell is giving me a sinus infection. Can I take action against anyone?

You can bring a pers inj/prop damage claim against the owner of that apt (Sponsor).

From your stated it facts it certainly seems that you have a viable action with several possible causes of action against the owner of that apartment, we do specialize in these types of cases ..however, we would need some more information before making a complete and proper determination.
